1. Heard the learned counsel for the petitioner and learned counsel for the State.

2. The petitioner seeks bail in connection with Dumariyaghat P.S. Case No. 211 of 2023 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act.

3. Recovery is of total 527.04 litres of foreign liquor.

4. Learned counsel for the petitioner submits that the petitioner is in custody since 22.07.2023 and has clean antecedent.

5. Learned counsel for the petitioner further submits that the petitioner has offered to deposit Rs. 25,000/- in

Patna High Court CR. MISC. No.66855 of 2023(2) dt.16-10-2023 2/2 Ram Krishna Mission Ashram, Latu Maharaj Path, Opp. Circuit House, Saran, Chapra, Bihar, 841301.

6. Considering the aforesaid facts, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No.3, Motihari, East Champaran in connection with Dumariyaghat P.S. Case No. 211 of 2023.

8. Petitioner's bail bond shall be accepted only after he produces the receipt of the amount of Rs. 25,000/- issued by Ram Krishna Mission Ashram, Latu Maharaj Path, Opp. Circuit House, Saran, Chapra, Bihar, 841301. (Sandeep Kumar, J) Guddu/- U T
