The petitioner apprehends her arrest in connection with Complaint Case No.30034(C) of 2014 registered under Sections 406, 417 of the Indian Penal Code.

The complainant alleged that she had talked to sell a piece of land of survey plot No.3102 and 3103. The complaint agreed to purchase the land on payment of Rs.27 lakhs. Complainant paid Rs.4,51,000/- to Balay Ganguly and a deed of agreement to sell was also executed but later on by receiving of Rs.19 lakhs, Balay Ganguly did not execute the sale deed.

The learned counsel for the petitioner submits that petitioner

Patna High Court Cr.Misc. No.63681 of 2017 (2) dt.11-01-2018 2/2 did not receive any single farthing. She is only a witness to the date of agreement to sell.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, in the event of her arrest or surrender before the learned Court below within a period of four weeks from the date of receipt / production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrte Ist Class, Patna in connection with Complaint Case No.30034(C) of 2014, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
