2. The petitioner apprehends arrest in connection with Sonpur PS Case No.787 of 2024 dated 25.09.2024, instituted under Sections 126, 115(2), 303(2), 317(5), 3(5) of the Bharatiya Nyaya Sanhita, 2023.

The prosecution case, in brief, is that on the alleged date of occurrence, FIR named accused, Vikash Kumar and Bittu Kumar Sah assaulted the informant and snatched his mobile and twenty five thousand rupees. Later on, mother of Vikash Kumar returned the mobile to the informant, but money was not returned.

4. Learned counsel for the petitioner submits that the

Only on the basis of confessional statement of co-accused, Vikash Kumar, the petitioner has been made accused in this case. Nothing has been recovered from the possession of the petitioner. Further submission is that apprehended co-accused, Vikash Kumar, has been granted bail by the lower court itself. It is also submitted that specific allegation of snatching the mobile and twenty five thousand rupees from the informant is against Vikash Kumar. Lastly, it is submitted that the petitioner has clean antecedents.

5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Saran at Chapra, in Sonpur PS Case No.787 of 2024, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

7. The application stands allowed.
