No.3365 of 2010 which in turn arises out of Complaint Case No.19C of 2010 pending in the court of Judicial Magistrate, 1st Class, Bettiah. The allegation against the petitioner is that he committed the acts of cheating in the context of selling of a vehicle. Apprehending his arrest, the petitioner filed A.B.P. No.767 of 2012 in the court of learned single Judge, Bettiah, West Champaran, which was dismissed through order dated 14.9.2012. Hence, this application for grant of anticipatory bail under Section-438 of Cr.P.C.

Heard learned counsel for the petitioner and learned A.P.P. for the State.

Even if the allegations against the petitioner are taken to be true, they are only referable to some civil

Patna High Court Cr.Misc. No.40965 of 2012 (3) dt.10-03-2015 2/2 disputes. In view of the nature of dispute, it is not essential to arrest the petitioner. The application is allowed.

In the event of arrest, the petitioner is directed to be released on bail upon furnishing the bailbond of Rs.10,000/- (ten thousand) along with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Bettiah, West Champaran, in connection with Tr. No.3365 of 2010 which in turn arises out of Complaint Case No.19C of 2010.
