Mr. Ashok Kumar Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJIV ROY ORAL ORDER 13-10-2025 Heard Mr. Ramesh Kumar Singh, learned counsel for the petitioner and Mr. Ashok Kumar Singh, learned APP representing the State.

2. The petitioners are apprehending arrest in connection with Khagaria (Gangaur) P.S. Case No. 179 of 2025 registered for the offence punishable under Sections 126(2), 115(2), 329, 303(2), 352, 109(1), 351(2) and 3(5) of the B.N.S., lodged on 06.06.2025 by the informant Angad Kumar.

3. As per the prosecution story, the informant alleged that on reaching near a temple, he found the two accused/petitioners herein causing damage to a vehicle and upon objecting to it, got assaulted. The allegation of opening fire as

4. Learned counsel for the petitioner submits that there is delay in lodging of the F.I.R., the injury has not been found to be grievous in nature and only because of criminal antecedent, got implicated.

5. Learned APP on the other hand opposes the prayer submitting that both the petitioners have criminal antecedent, and injury has been found on the head of the informant.

6. Considering the submissions of the parties as also that both the petitioners have criminal antecedent, the allegation that has come stands supported as per the observation of the learned Sessions Judge, in that background, no relief can be extended to them.
