The present Writ Petition has been filed for a direction to the respondent to publish the final results of a total of 5280 + 167 posts as per advertisement No. CRPD/CBO/2023-24/18 published by the respondents for which applications were invited, examination was conducted and interview letters were issued to the persons who declared successful in the written examination. The petitioner has further prayed for a direction to the respondents to fill up the vacant posts advertised through the above advertisement by the respondent -bank after preparing final result.

3. Learned Counsel for the petitioner submits that in pursuance to Advertisement No. CRPD/CBO/2023-24/18, the petitioner appeared in the written test organized by the

Patna High Court CWJC No.14994 of 2024(2) dt.07-10-2024 2/3 respondents and was found qualified in the said examination. Thereafter, an interview letter was issued to him to face an interview on 23.06.2024 in New Delhi. The respondents have published the final result of only 3720 applicants against the vacant post of 5280 + 167 Circle Based Officer and as such, the candidates who were issued interview letters as per their performance in the process of selection and appointment have lost their chance to finally selected though they scored qualifying marks in all parameter fixed by the Bank. It is further submitted that the petitioner belongs to the General Category and got 60.60 marks and has not been finally selected due to cut-off marks said to be fixed 60.28. Thereafter, the present Writ Petition.

Learned Counsel for the State Bank of India submits that from the advertisement which has been annexed in the present Writ Petition as Annexure - P/1, it transpires that the said recruitment has to be made circle-wise and against the said circle the name of State /U.T. has been mentioned but Bihar has not been mentioned. In the said advertisement, it has been clearly mentioned that the above vacancies are provisional and may vary depending on the Bank's actual requirements. The candidate will have to apply for a vacancy of one Circle only. A

Patna High Court CWJC No.14994 of 2024(2) dt.07-10-2024 3/3 candidate applying against vacancy of one Circle will not be eligible to apply against vacancy of any other circle. Selected candidates will be posted in the Circle against whose vacancy they are selected. The said recruitment was published by the office of General Manager (RP & PM), Mumbai. Learned Counsel further submits that either from the advertisement or from the pleading, it is not clear that for which Circle the petitioner had applied for. Since neither the advertisement made from Bihar nor the vacancy was relating to Bihar Circle, therefore, this Court has no jurisdiction to entertain the present Writ Petition.

5. Upon going through the advertisement, it transpires to this Court that there was no vacancy in Bihar State as per the advertisement, and publication of the advertisement has been made from Mumbai. It is also not clear from the pleadings of the petitioner that for which Circle, the petitioner had applied. As such, without entering into the merit and demerit of this Writ Petition, the present Writ Petition is disposed of granting liberty to the petition to file Writ Petition before the Court having territorial jurisdiction.
