====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-11-2023 Heard learned counsel for the petitioner and Mr. Pramod Kumar Pandey, learned A.P.P. for the State.

2. Petitioner apprehends arrest in case registered for the offence punishable under Section 387 of the Indian Penal Code.

3. As per prosecution case, mobile holder of the No. 7004113133 demanded rangdari of Rs. 5 lacs from the informant and threatened him to suffer with dire consequences if the same was not paid.

4. Learned counsel for the petitioner submits that petitioner is not owner of the mobile as detailed in the F.I.R. and his name has transpired only on the basis of confessional statement of co-accused.

5. Learned A.P.P. for the State opposes the bail

Patna High Court CR. MISC. No.69617 of 2023(2) dt.01-11-2023 2/2 application and submits that petitioner has got two criminal antecedents of similar nature.
