2. The petitioner has prayed for bail in a case registered for the offence punishable under Sections 363 of the Indian Penal Code. Later on Sections 364, 302, 201, 120(B) and 34 of the I.P.C. were also added.
3. As per allegation in the FIR, the brother of the informant Mr. Ajit Kumar left the house saying that he is going to one Sujeet Kumar @ Kajal and thereafter he will got to meet a person at Barauni and Hajipur. If that person is met all will go to Delhi and if he is not find then Ajit would return back but he did not return. During investigation, the dead body of the victim was found.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. He is not named in the F.I.R. rather his name has been transpired in this case on the basis confessional statement of Sujeet Kumar who is solely named accused person of this case. No one is eye witness of the alleged occurrence and petitioner has no concerned with the said occurrence. There is no specific overt act against the petitioner and no consistent evidence has come against him which shows his complicity in this case. The sole named accused Sujeet Kumar @ Kajal has already been granted by a co-ordinate Bench of this court vide order dated 13.12.2019 passed in Cr. Misc. No. 82874 of 2019. Petitioner is languishing in judicial custody since 27.03.2023.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the
