Petitioner, already in custody, seeks bail in connection with Nokha P.S. Case No.254 of 2016, registered under Sections 8(C), 20(B), 22, 27(A) and 29 of the N.D.P.S. Act. Allegation in brief is that 124 Kgs. of Ganja was recovered from the house of the petitioner.
Learned counsel for the petitioner submits that the samples extracted from the seized Ganja was not according to the law as Ganjas were taken out from each packet and mixed, so there is bleak chance of conviction. He further submits that the Ganja was kept there by one other co-accused Sanjay Bharti. Having considered the huge quantity of Ganja
Patna High Court Cr.Misc. No.63243 of 2017 (3) dt.15-01-2018 2 /2 recovered from the house of the petitioner, the prayer of bail of the petitioner is rejected in connection with Nokha P.S. Case No.254 of 2016, pending in the court of learned Additional Sessions Judge-IV, Sasaram, District Rohtas.
