1. Heard learned counsel for the parties.

2. The petitioner has filed the instant application for grant of regular bail in connection with Industrial Area P.S. Case no. 29 of 2023 registered under sections 307, 341, 323, 354B, 335 and 504/34 of the Indian Penal Code.

3. As per the prosecution case, it is stated that the petitioner and one another were abusing and threatening the informant and the members of her family on the ground that the informant's nephew was responsible for the petitioner going to jail on earlier occasion. It is stated that the accused persons came variously armed and assaulted the son of the informant. Further the petitioner also misbehaved with the informant and also abused her. Anksush Kumar and Sircharan Kumar beat up the informant's son as a result of which he became unconscious.

4. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.67235 of 2023(2) dt.19-10-2023 2/2 petitioner has been false implicated in the case on ground of enmity between the parties which is evident from the FIR itself. Allegations against the petitioner are general and omnibus in nature. The main allegation of assault is on Ankush Kumar and Sircharan Kumar. The petitioner is in custody since 22.6.2023 and charge-sheet has been submitted in the case.

5. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner, the nature of allegations against this petitioner in the FIR, his being in custody since 22.6.2023 and charge-sheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Industrial Area P.S. Case no. 29 of 2023 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Bhagalpur.
