Petitioners apprehend arrest in connection with Mehdiganj Police Station Case No. 84 of 2017 registered for the offences under sections 323, 341, 307, 379, 385, 504, 506/34 of the Indian Penal Code.
It has been submitted that the allegation of assault and snatching Rs.10,000/- and a gold chain is omnibus against 12 persons. Further submission is that some scuffle took place between the parties on the occasion of Durga Puja. The injury report, which is copied at para 30-31 of the case diary, shows that two injured sustained simple injury. Petitioners have clean antecedent.
Considering the facts and circumstances of the case, the
Patna High Court Cr.Misc. No.251 of 2018 (3) dt.01-02-2018 2/2 prayer for bail is allowed and the above named petitioners in the event of arrest or surrender before the learned court below within six weeks from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Patna City in connection with Mehdiganj Police Station Case No. 84 of 2017, subject to conditions as laid down under section 438(2) Cr.P.C.
with further conditions: (1) one of the bailors of the petitioners shall be local person having sufficient immovable property within the jurisdiction of the concerned Court, (2) the petitioners will not induce any witness or tamper with the evidence (3) the petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of their bail and (4) If the petitioners are found involved in similar type of offence in future, the prosecution will have liberty to move for cancellation of their bail.
