2. The petitioner seeks bail in connection with Special Case No. 59 of 2023 arising out of Dagarua P.S. Case No. 173 of 2023 registered for the offence under Sections 8C, 21B, 25, 29 of the N.D.P.S. Act.

3. Learned counsel for the petitioner submits that the petitioner is in custody since 01.06.2023 and there is recovery of 90 grams of Smack (Brown Sugar) from his possession.

4. Learned APP has vehemently opposed the prayer of bail.

5. Considering the period of custody and recovery of intermittent quantity of Smack (Brown Sugar) from his possession, this application for regular bail is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, N.D.P.S Act, Purnea in connection with Special Case No. 59 of 2023 arising out of Dagarua P.S. Case No. 173 of 2023.

The petitioner will visit Dagarua Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
