Mr.Khurshid Anwar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJESH KUMAR VERMA ORAL ORDER 20-03-2023 Heard learned counsel for the petitioner, learned counsel appearing for the informant and the learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offence under Sections 498(A), 341,323,313,504,506 of IPC. Petitioner is husband of the informant. Allegation against the petitioner and others is of committing torture upon the victim due to non-fulfillment of demand of dowry and they also tried to kill the informant and her child. Learned counsel for the petitioner submits that the informant is not the legally wedded wife of the petitioner and he has no concern with the informant or her child. Pursuant to the order dated 07.12.2022, the petitioner and the informant are present in the Court.

2/4 Learned counsel appearing for the petitioner, on the instruction of the petitioner, submits that the informant is not the legally wedded wife of the petitioner but outrightly fairly submits that the petitioner is ready to give Rs. 7,500/- per month to the informant, namely, Ranju Devi and her child, namely, Aryan Verma, aged about 08 years, for their maintenance.

Learned court below is directed to constitute the Medical Board and send the sample for D.N.A.Test of child, namely, Aryan Verma, aged about 08 years and petitioner, namely, Akash Verma, who is father of the petitioner and his mother, namely, Ranju Devi, who is informant of the present FIR.

Learned counsel appears on behalf of the informant submits that he has no objection in this regard. The provisional bail granted to the petitioner vide order dated 07.12.2022 is hereby confirmed in connection with Chakand P.S.Case No.177 of 2022 with the following conditions:-

(1) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the

3/4 Court and on his/her absence on two consecutive dates without sufficient reason, his/her bail bond shall be cancelled by the Court below.

(2) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.

(3) The petitioner shall deposit Rs. 7,500/- per month in the account of the informant, namely, Ranju Devi in the last week of every month till the disposal of the present case/ maintenance case, if filed by the informant. The bank details of the informant, namely, Ranju Devi, is as follows:

If petitioner fails in depositing the same, the learned court below shall be at liberty to cancel the bail bond of the petitioner.

(4) And, further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage, it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the

4/4 acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
