Petitioner seeks regular bail in connection with Barun P.S. Case No. 330 of 2022 registered for the offences punishable under Sections 341, 354, 504, 506 of the Indian Penal Code and Section 12 of POCSO Act.

As per the prosecution, the informant (victim) alleged that this petitioner molested her and forcibly tried to give her a mobile phone.

The main submissions advanced by the learned counsel for the petitioner are that the petitioner has been languishing in jail since 13.09.2022, he is a student and the father of the informant and the family of the petitioner had no good relation when the FIR was lodged and owing to the said

No.66518 of 2022(3) dt.15-03-2023 2/2 bad relation the instant case was filed due to dirty village politics, though against the petitioner there are criminal antecedent of three cases but they were lodged with different nature of allegations and against the petitioner there is simple allegation of having misbehaved with the victim. Learned APP appearing for the State has opposed the bail prayer.

In view of the facts as stated above, in the opinion of this court, the petitioner deserves to a lenient approach of this court. Accordingly, let the petitioner be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Barun P.S. Case No. 330 of 2022.

Further the bail bond of the petitioner will be accepted after framing of charge.
