====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 13-10-2025 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State.
2. The petitioner seeks bail in connection with Chiksaura P.S. Case No. 113 of 2025 dated 04.07.2025 registered for the offences punishable under Sections 126(2), 115(2), 118(1), 109(1), 352 read with Section 3(5) of the B.N.S., 2023 and Section 27 of the Arms Act.
3. As per the prosecution case, the petitioner alongwith the other co-accused persons started abusing the informant, when the informant objected, all of them caught hold of the informant and took him on the street with an intention to kill him and in the meantime, the petitioner assaulted with the
Patna High Court CR. MISC. No.65570 of 2025(2) dt.13-10-2025 2/3 stick on the informant's head, due to which, he sustained head injury. After that the co-accused Anish Kumar caught hold of the informant's neck and the co-accused Praveen Kumar fired from the pistol which hit the informant's waist on the right side. The second shot was fired by the co-accused Ranjeet Kumar which hit on the informant's left kidney. It is further alleged that all the accused persons attacked the informant with an intention to kill him.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is submitted that the allegation against the petitioner is that he assaulted with lathi on the head of the informant but from perusal of the injury report, it appears that the injury sustained by the informant is simple in nature. There are several criminal cases lodged against the informant. The petitioner is a student and after completing his graduation, he is residing in Patna for preparation of the competitive examination for getting the government job and he was not present at the time of the alleged occurrence. He has also appeared in the competitive examination held on 19.07.2025 in the Bihar State Power (Holding) Company Limited with the permission of learned court below. There is a case and counter case between the
Patna High Court CR. MISC. No.65570 of 2025(2) dt.13-10-2025 3/3 parties. Both parties are agnates. The charge sheet has been submitted against the petitioner. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail petition. He is in custody in this case since 04.07.2025.
5. Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned J.M.-Ist Class, Hilsa, Nalanda in connection with Chiksaura P.S. Case No. 113 of 2025.
7. The application stands allowed.
