JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-04-2018 The petitioner is apprehending his arrest in connection with Ramnagar P.S. Case No. 165/2017, registered for offences punishable under Sections 376, 313, 504/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. Allegation against the petitioner is of establishing sexual relationship, promising marriage and further a panchayati was held, in which the petitioner agreed to marry the informant and again established physical relationship, however, he started demanding dowry.

It has been submitted on behalf of the petitioner that he has falsely been made accused in this case and both petitioner and informant are major and there was love affair between the parties and whatever they did they did with consent of each other. So far

Patna High Court Cr.Misc. No.63432 of 2017 (6) dt.09-04-2018 2/2 allegation of demand of dowry is concerned, the same is an afterthought and ornamental in nature.

Learned counsel for the State opposed the prayer for bail on the ground that there is direct allegation against the petitioner. Having heard both sides, in view of the above facts, I am not inclined to grant the privilege of anticipatory bail to the petitioner, this application is accordingly dismissed. However, the petitioner if so desire may surrender before the court below within a period of four weeks and pray for regular, which will be disposed of by the court below on the merit of the case.
