The petitioner seeks bail in a case registered under Sections 304, 316, 34 of the Indian Penal Code. The prosecution case in brief is that while the informant was taking his wife to Bettiah for her treatment, in the way, he met with the petitioner who offered him for treatment of his wife and took informant's wife to the hospital where some injection was given to her and consequently, the wife of the informant died.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 23-07-2019. The petitioner has

Patna High Court CR. MISC. No.60473 of 2019(2) dt.24-09-2019 2/2 been made accused in the present case due to mistake of fact. The petitioner is alleged to be compounder of one Dr. Chandan Kumar. The petitioner is not named in the FIR. His name transpired in this case in course of investigation. Co-accused Chandan Kumar has already been granted bail by a co-ordinate bench of this court vide Annexure-3 to this application. A petition has been filed by the informant in the court below where he has stated that the petitioner is not compounder of the doctor Chandan Kumar. Same is Annexure-2 to the present application.

On behalf of the State, it is submitted that the petitioner is not named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Harsidhi P.S.
