====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE and HONOURABLE JUSTICE SMT. ANJANA MISHRA ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 11-12-2018 Heard Shri Mrigendra Kumar, learned counsel for the State of Bihar.
2. The defect as pointed out by the office with regard to an application for condoning the delay has not yet been removed. We have also gone through the impugned judgment.
3. As a matter of fact, this appeal has been preferred belatedly which virtually raises an issue that already stands answered by a Division Bench of this Court in the case of Ashok Kumar Mishra Vs. State of Bihar, reported in 2003(1)
Patna High Court LPA No.352 of 2018(3) dt.11-12-2018 2/2 PLJR 172.
4. We find no good ground to differ from the view taken by the Division Bench in the aforesaid case and, therefore, this appeal does not deserve to be entertained either by condoning the delay or even on merits.
5. The appeal stands rejected accordingly.
