This is an application for grant of anticipatory bail in connection with Chiraiya (Shikarganj) PS case no. 315 of 2017 registered for the offences punishable under Section 379 of Indian Penal Code.
The allegation is regarding some persons stealing the motorcycle from the house of the informant and the present case was lodged by the informant suspecting that the petitioner herein and one other co-accused person had stolen the motorcycle. The learned counsel for the petitioner submits that merely on the basis of suspicion, the petitioner has been implicated in the present case whereas neither any recovery of
Patna High Court Cr.Misc. No.63128 of 2017 (3) dt.15-03-2018 2/2 motorcycle has been made from the possession of the petitioner herein nor any material to that effect has come in the case diary. It is further submitted that the case diary would bear it out that there is admittedly a dispute in between the informant side and the petitioner side.
Having regard to the facts and circumstances of the case, the abovenamed petitioner, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/ production of a copy of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-1, Sikarhana at Dhaka, East Champaran at Motihari in connection with Chiraiya (Shikarganj) PS case no. 315 of 2017 subject to the conditions as laid down under Section 438(2) of Code of Criminal Procedure.
