2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 354(A), 353, 504, 506 and 34 of the Indian Penal Code.

3. As per the prosecution case, on the alleged date and time of occurrence, the Board meeting of Nagar Panchayat, Simrahi was going on in Nagar Panchayat Office, during the proceeding of meeting husband of Chief Councilor namely, Vijay Choudhary (petitioner no.1) and her son Vivek Jaiswal

Patna High Court CR. MISC. No.68679 of 2023(2) dt.19-10-2023 2/3 (petitioner no.2) suddenly entered into the meeting hall and started misbehaving with the informant and abused her and tried to snatch the government register forcibly and obstructed in discharge of official duty.

4. It is submitted by the counsel for petitioner that due to political vendetta these petitioners who are family members of chief councilor have been falsely implicated in this case. As a matter of fact, these petitioners were raising issues and grievances of public concern which enraged the informant and just to create pressure upon chief councilor for getting her support in illegal activities of Nagar Parishad, lodged this case. Petitioner no. 2 claims clean antecedent. Petitioner no. 1 has got one criminal antecedent in which he is on bail.

Considering the facts aforesaid, the petitioner above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Birpur, Supaul in connection with Raghopur P.S. Case No. 196 of 2023, subject to the conditions as laid down under Section
