JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-09-2024 At the outset, the learned counsel for the petitioners seeks to make certain corrections in paragraph no. 1 of the present writ petition. Permission, so sought, is granted. 2.

Though the present writ petition has been filed for directing the Deputy Collector Land Reforms, Biharsharif, DistrictNalanda to measure the land of the petitioners appertaining to Khata No. 948, Khesra No. 4631 situated at Mauza-Shankardih, Thana No. 146, District-Nalanda at Biharsharif as also the petitioner seeks quashing of the encroachment

Patna High Court CWJC No.14707 of 2024(2) dt.25-09-2024 2/2 proceedings initiated by the Circle Officer, Parwalpur, DistrictNalanda vide Encroachment Case No. 02 of 2024-25, however, at the outset, the learned counsel for the petitioners seeks liberty on behalf of the petitioners to file their detailed objections as also application for re-measurement, before the Circle Officer, Parwalpur, District-Nalanda and further seeks a direction upon the Circle Officer, Parwalpur, District-Nalanda to consider the same in accordance with law and pass the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956 and till then it is prayed that no coercive action be taken against the petitioners. It is directed accordingly. 4.

The writ petition stands disposed off on the aforesaid terms.
