JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-04-2026 Heard learned counsel appearing on behalf of the petitioner, learned APP appearing on behalf of the State and learned counsel appearing on behalf of the informant.

2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 103 and 3(5) of the B.N.S. and Section 27 of the Arms Act.

3. As per prosecution case, it is alleged that this petitioner, along with other accused persons, wearing masks and helmet, came and started firing on the Bus due to which, driver Dushyant Kumar Mishra died.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. Petitioner has falsely been implicated in

5. On the other hand, learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that petitioner is named in the F.I.R. and there is specific accusation that he, along with other F.I.R. named and 5 to 6 unknown accused persons, fired upon bus of informant due to which driver of the bus died. During investigation, Manager Sanjay Kumar, conductor Anant and khalasi, who managed to flee from the place of occurrence, have supported the prosecution case. The mobile tower location of this petitioner was also found at the place of occurrence. Petitioner has got three criminal antecedents.

6. Considering the facts and circumstances of the case, specific and direct nature of accusation, materials that have surfaced during course of investigation and criminal antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is rejected.
