Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 27.3.2017 passed in Cr. Misc. No.14403 of 2017, with a direction to the learned trial court to conclude the trial within a period of seven months, however, submission of the learned counsel for petitioner is that seven months' period has already expired and the case is still pending for the evidence. He is in custody for more than one year. Heard learned A.P.P. also.
A report was also called for from which it appears that a case is still pending at the stage of evidence, in such view of the matter, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with
Patna High Court Cr.Misc. No.62392 of 2017 (3) dt.17-01-2018 2/2 two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-III-cum-Special Judge, Excise Act, Khagaria in connection with Parbatta P.S.Case No.166 of 2016, with condition that he will co-operate in disposal of the trial and will also appear as and when required by the learned court below and he will also appear before the local police station of his area in the first week of each month for a period of six months so that the police may watch is conduct, otherwise his bail bond shall be cancelled.

With the aforesaid observation, this application is allowed.
