The petitioner seeks bail in a case instituted under Sections 30(a), 38(i) (ii), 41(i) of Bihar Prohibition and Excise Act, 2016.
The prosecution case, in brief, is that huge quantity of wine is recovered from different vehicles.
The petitioner is in custody since 17.10.2017. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. It is alleged that huge quantity of wine is recovered from different vehicles in question. So far petitioner is concerned, only one mobile is recovered. The
Patna High Court Cr.Misc. No.62204 of 2017 (2) dt.11-01-2018 2/2 other co-accused have been granted bail vide Cr. Misc. No.55491/2017, 56526/2017 and 56384/2017. There is no compliance of Section 100 of the Cr.P.C.
On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-cum-Special Judge, Excise Act, Samastipur, in connection with Dalsinghsarai P.S. Case No.303/2017.
