2. The petitioner is apprehending his arrest in Nalanda Cyber P.S. Case No. 11 of 2025 registered under Sections 3316(2), 318(4), 319(2), 303(2), 336(3), 338, 340(2), 61(2) of Bhartiya Nyay Sanhita, 2023 and 66, 66©,66(D) of I.T. Act.

3. According to allegation, having received the information that some cyber criminals were assembled, the police raided the place of occurrence from where, the co-accused Amit Raj @ Murari Kumar was arrested. Three mobile sets were recovered from possession of said Amit Raj @ Murari Kumar. It has also been mentioned in the FIR that the evidence of transaction of money was found. The apprehended co-accused disclosed the complicity of the petitioner in the alleged occurrence.

4. It has been submitted on behalf of the petitioner that the petitioner is a person of clean antecedent. No incriminating article

Patna High Court CR. MISC. No.63881 of 2025(2) dt.17-09-2025 2/2 was recovered from possession of the petitioner and the co-accused Amit Raj @ Murari Kumar has been granted bail by learned court below itself.

5. Learned APP has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of four weeks, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bihar Sharif, Nalanda in connection with Nalanda Cyber P.S. Case No. 11 of 2025, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure with further following conditions: (i) The petitioner shall cooperate with the trial and make himself available as and when required by the court. (ii) The petitioner will appear in the court below on each and every date fixed in the case till framing of charge. (iii) The learned court below shall verify the criminal antecedent of the petitioner.
