JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-09-2019 This is an application for grant of anticipatory bail in connection with Hawai Adda P. S. Case No. 213 of 2019, (Special Case No. 7134 of 2019), disclosing offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. As per F.I.R. police got a confidential information that petitioner and other accused persons left the country made liquor near the transformer and the police recovered 08 liters of country made liquor from a bag and the accused persons succeeded in fleeing away. The local villagers have named this petitioner.
Submission of the learned counsel for the petitioner is that the petitioner has been falsely implicated in this case, having no criminal antecedent.

No.60257 of 2019(2) dt.24-09-2019 2/2 Having heard both sides, in view of the facts, as stated above, this application is disposed of with a direction to the petitioner to surrender before the learned court below and make prayer for regular bail, which will be considered by the Special Judge, considering the fact as to whether there are any witness except police witness, who named the petitioner and considering the same, he will pass an appropriate order and dispose of his prayer for bail on the same day.
