JUSTICE JITENDRA KUMAR ORAL ORDER 07-11-2025 The present appeal has been filed against the acquittal of the Respondent Nos. 2 to 7 of the charge framed under Section 307/34 and other allied Sections of the Indian Penal Code.
2. Hence, office has raised objection that Appeal will be filed as Cr. Appeal (D.B.) and not Cr. Appeal (SJ).
3. Learned counsel for the Appellant agrees with the
Patna High Court CR. APP (SJ) No.4476 of 2024(3) dt.07-11-2025 2/2 view. Even this Court is of the view that this Appeal may be filed as Criminal Appeal (D.B.) and at this stage, learned counsel for the Appellant is seeking permission to convert this present Appeal into Criminal Appeal (D.B.).
3. Accordingly, the present Appeal is converted into Criminal Appeal (D.B.) and office is directed to do necessary correction in the matter on steps if any required to be taken by learned counsel for the Appellant and thereafter, list before appropriate Bench after obtaining approval of Hon'ble the Chief Justice.
