The petitioner seeks regular bail in connection with Rafiganj P.S. Case No. 187 of 2017 instituted for the offences under Sections 30(a) 38(I), 38(II) of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 542 litres of country made liquor and 15 litres of illicit foreign liquor from the house of one Manoj Singh who is the co-accused person and it has transpired during the course of investigation by the Police that the petitioner used to purchase liquor from the said Manoj Singh for the purpose of selling in the market.

The learned counsel for the petitioner submits that the

No.63182 of 2017 (2) dt.17-01-2018 2/2 petitioner has been falsely implicated in the present case and no recovery has been effected from the house of the petitioner, he has a fair antecedent barring one case in which he is on bail. It is submitted that the petitioner is in custody since 18.11.2017. Considering the nature of accusation and the period of custody already undergone, I deem it fit and proper to enlarge the petitioner above named on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII-cum-Special Judge (Excise), Aurangabad in connection with Rafiganj P.S. Case No. 187 of 2017.
