JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 12-01-2018 Heard learned counsel for the petitioners and learned counsel representing the State.
Petitioners are seeking regular bail in Kahalgaon (Ghogha) P.S. Case No. 450 of 2016 registered under Sections 147, 149, 448, 342, 323, 379, 504, 506 of the Indian Penal Code and later on Section 302 IPC was also added.
Learned counsel for the petitioners submits that in the First Information Report the informant has named the persons, who had entered in his house and had assaulted his son and one Kalicharan. Kalicharan is said to have died because of the injuries inflicted upon his body by the named accused persons. Learned counsel submits that the names of these petitioners have transpired only in course of investigation even though there is no material to
Patna High Court Cr.Misc. No.181 of 2018 (2) dt.12-01-2018 2/2 connect them in connection with this case. He has further submitted that the named accused have been granted bail by coordinate benches of this Court vide Annexure - 3 series to the present application.
Considering the facts and circumstances of the case, let the petitioners, named above, be released on bail on their furnishing bail bonds of Rs. 15,000/- (Fifteen thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Kahalgaon (Ghogha) P.S. Case No. 450 of 2016, subject to the conditions as laid down under Section 437(3) Cr.P.C. and further conditions that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned court, the petitioners will not induce any witness or tamper with the evidence, the petitioners shall cooperate in disposal of trial and make themselves available as and when required by the court and in the event of failure on their part to appear before the court below on two consecutive dates without showing any genuine reason, their bail bonds shall be cancelled by the court below.
