The petitioner apprehends his arrest in Complaint Case .244 of 2017 registered under Sections 406, 420, 504, 120(B) of the Indian Penal Code.

The learned counsel for the petitioner submits that the complainant alleged that all the accused persons hatching of conspiracy of the non-banking company in the house of Mukesh Sah, the petitioner.

It is further alleged that the complainant and other persons became the agent of the company and deposited huge mount. Ranjan Kumar Singh and Ratan Kumar Singh assured them to

Patna High Court Cr.Misc. No.63685 of 2017 (2) dt.11-01-2018 2/2 return the entire amount. After maturity, all the accused persons fled away after closing the office of the company. Learned counsel for the petitioner submits that petitioner is not an official of the company. Ranjan Kumar Singh and Ratan Kumar Singh took the house of the petitioner on rent. The petitioner did not persuade any complainant or any other person to deposit the money in the bank.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt / production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Darbhanga in connection with Complaint Case No.244 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
