2. The petitioner has preferred this application for grant of regular bail in connection with Bangra @ N.H. Bangra P.S. Case No. 03 of 2024 dated 06.01.2024 registered for the offences punishable u/ss 399 and 402 of the Indian Penal Code and Sections 25(1-B)a, 26 and 35 of the Arms Act.

3. As per the prosecution case, the petitioner and the co-accused persons were gathered to commit crime. Upon seeing the police, the accused persons started fleeing away but three of them were apprehended by police. On search, one loaded country-made pistol, ATM card, Aadhar card, mobile and keypad were recovered from the possession of the co-accused

Patna High Court CR. MISC. No.72173 of 2024(2) dt.03-10-2024 2/3 persons. It is further alleged that the apprehended accused persons alleged that on the instruction of the petitioner, they were assembled for committing crime.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The apprehended co-accused persons disclosed the name of the petitioner. Nothing has been recovered from the conscious possession of the petitioner. The co-accused person has already been granted regular bail by this court vide order dated 06.05.2024 passed in Cr. Misc. No. 31806 of 2024. The petitioner is accused in seven other criminal cases as stated in para 3 of the bail petition. The petitioner is in custody since 10.06.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Samastipur in connection with Bangra P.S. Case No. 03 of 2024 with the condition :- (i) The petitioner is directed to remain physically present
