The present application has been filed praying for quashing the order dated 02.07.2013 passed in Miscellaneous Case No. 16 of 2013(arising out of Title Execution Case No. 02 of 2012) whereby the court below has dismissed the petition filed by the petitioners.
It transpires from the records as well as from the impugned order that this petition was filed by the present petitioners under Order 1 Rule 97 in the execution case claiming their
Patna High Court CWJC No.15445 of 2013 dt.16-01-2017 preferential right to purchase the suit land. The learned court below after considering the facts and materials on record has come to the conclusion that the petitioners have no title or possession over the suit land and on that basis has rejected the miscellaneous case initiated on the basis of the petition filed by the petitioners.
In this factual background, this Court is not inclined to interfere with the impugned order to invoke its jurisdiction under Article 227 of the Constitution of India.
The application is, accordingly, dismissed.
