Mr. Ashok Kumar Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 23-09-2020 Heard Mr. Ashok Kumar Choudhary, learned counsel for the petitioner and the learned Additional P.P. through video conferencing.

The petitioner seeks bail in Nardiganj P.S. Case No.165 of 2013, corresponding S. Tr. No.159/15/525/15, registered under Sections 147, 148, 149, 341, 323, 324, 307, 337, 338, 504 and 302 of the Indian Penal Code. Learned counsel for the petitioner submits that the prayer for bail of the petitioner was thrice rejected by this Court with a direction to the trial court to conclude the trial within six months from the date of receipt of this order vide order dated 18.01.2017, passed in Cr. Misc. No.23943 of 2016 but the trial has not yet been concluded.

On such submission, a report was called for. The

Patna High Court CR. MISC. No.67734 of 2019(5) dt.23-09-2020 2/2 learned Additional Sessions Judge reported that the trial has already been concluded and the case is fixed for judgment. In this view of the fact, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner is rejected.

The learned trial court is directed to deliver the judgment within two weeks from the date of receipt of this order.

Let a copy of this order be sent to the learned trial judge for information and needful.

If the judgment is not delivered within two weeks, the learned trial judge shall report to this Court as to why the judgment is not being delivered as the trial court was directed to conclude the trial within six months in the year 2017. (Prabhat Kumar Jha, J) S.KUMAR/- U T
