JUSTICE RAJIV ROY ORAL ORDER 11-04-2023 Heard learned counsel for the petitioner and the learned APP for the State The petitioner apprehends his arrest in connection with Turkoulia (Raghunathpur O.P.) P.S. Case No.174 of 2022 instituted under Sections 147, 148, 341, 323, 327, 384, 386, 120(B) of the Indian Penal Code and Section 27 of the Arms Act lodged on 24.02.2022 by the informant, Pramod Kumar Singh. As per the prosecution story, the accused persons were occupying the land of the informant, which was being watched by Lalan Sahani and Mohan Sahani. They informed to the informant on his mobile phone. He thereafter reached there and found the accused persons were constructing pillar over the land and on protest, they abused and assaulted to the informant and Lalan Sahani as also Mohan Sahani further threatening that

It is further alleged that the accused persons also demanded Rs.25 Lacs extortion and threatened the informant of killing in case of non-fulfillment of the same. Co-accused Sonu Sahani also fired upon the informant who however save himself. Accordingly, the FIR.
It has been contended by the learned counsel for the petitioner that a bare perusal of the FIR would show that only to implicate the accused persons, this story has been created. It is further submission that the petitioner has nothing to do with the present case, is in studies and do not have criminal antecedent. Learned APP opposes the prayer for bail but concedes that there is no injury on the side of the informant. Taking into account the fact that he do not have criminal antecedent and there was no injury on the side of the informant, ultimately he has to face the music, this Court is inclined to grant him privilege of anticipatory bail. Let the petitioner be released on bail, in the event of his arrest or surrender before the Sub-ordinate court within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each in connection with Turkoulia
