2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 363, 365 of the Indian Penal Code subsequently in course of investigation Section 302 and 201 read with Section 34 of the Indian Penal Code has also been added vide order dated 19.06.2024.
3. The case of the prosecution is that the husband of the informant has gone to market with one Manish Manjhi and when he did not returned for a considerable time, the informant inquired about him. Manish Manjhi told that he has left the husband of the informant at Kawakol. The informant suspects

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. He has got no criminal antecedent. During course of investigation, Manish Manjhi has given in his confessional statement that he along with his associates have committed murder of Md. Sarvar Ali as he was having illicit relation with the wife of Manish. It is next submitted that the name of this petitioner has been surfaced on the basis of confessional statement of Manish Manjhi. It is also submitted that nothing has been recovered from the conscious possession of this petitioner. It is further submitted that the petitioner is languishing in judicial custody since 19.06.2024.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kawakol P.S. Case No. 189 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand)
