JUSTICE ARUN KUMAR ORAL ORDER 29-01-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Makhdumpur P.S.Case No. 84 of 2017 registered under Sections 498A and 302/34 of the Indian penal Code. Submission is that marriage was solemnised 12-13 years back and it was an accidental fire and in the FIR, there is no specific allegation against the petitioner and he, on the alleged date of occurrence, was in Delhi and father-in-law and mother-inlaw have been granted bail. Whereas learned counsel for the State submits that there is also specific allegation against the petitioner and he is husband and deceased died by 90% burning injury.
Since allegation is specific against the petitioner/husband, at present the prayer for bail of the petitioner is
Patna High Court Cr.Misc. No.63057 of 2017 (3) dt.29-01-2018 2/2 refuse. Trial court is directed to expedite the trial and conclude the same preferably within a year. If is it not concluded within stipulated period, petitioner may renew prayer for bail. (Arun Kumar, J) Sujit/- U T
