The petitioner apprehends her arrest in Supaul P.S. Case No.508 of 2018 registered under Sections 198, 420, 467, 468, 471, 477A and 120B of the Indian Penal Code. The gist of allegation is that the petitioner was appointed on the post of Niyojit Teacher but she submitted forged and fabricated caste certificate.

Learned counsel for the petitioner submits that the petitioner belongs to jaiswal caste which comes under BC category. The petitioner married with Noni Mohan Nehru and she is living with her husband. The husband belongs to Scheduled Caste. The petitioner filed application before Circle Officer, Murliganj, Madhepura for issuance of her caste

Patna High Court Cr.Misc. No.75435 of 2018(3) dt.10-01-2019 2/2 certificate on the basis of her marriage with a scheduled caste. The petitioner did not conceal any facts and the Circle Officer, Murliganj, Madhepura issued caste certificate showing the petitioner belongs to Scheduled Caste. Therefore, the petitioner neither committed any offence nor submitted any forged and fabricated caste certificate.

Having considered the facts aforesaid, the petitioner, above named, in the event of her arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Supaul P.S. Case No.508 of 2018, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
