2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 21, 22(a) (b) of the NDPS Act, registered in connection with Kankarbag P.S. Case No. 273 of 2024.

3. As per prosecution case, there has been recovery of some intoxicating medicine from the room of co-accused Brajesh Kumar. It is further alleged that a mobile set has been recovered from the possession of the petitioner.

4. The learned counsel for the petitioner has submitted that petitioner has been falsely implicated in this case and has committed no offence. Petitioner has no concern with the

The name of the petitioner has come into light on the basis of confessional statement of co-accused, which has no evidentiary value in the eyes of law. No incriminating article has been recovered from the conscious possession of the petitioner. Petitioner is a person of clean antecedent and he is in custody since 21.04.2024.

5. Learned APP for the State has opposed the prayer of bail.

Considering the above facts and circumstances of the case as well as petitioner having no criminal antecedent, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special (NDPS Act) Court No. 1, Patna in connection with Kankarbag P.S. Case No. 273 of 2024, subject to the condition that the petitioner shall co-operate in the disposal of trial and make himself available as and when required by the Court.
