The petitioner apprehends his arrest in Complaint case No. 2260 (C)/2015 for the offences allegedly committed by the petitioner under Section 406, 420 of the Indian Penal Code. The gist of the allegation is that the complainant had to purchase a pick-up van. The complainant came across with Anand Shankar @ Anand Kumar, the petitioner, who persuaded him to purchase Winner vehicle of Hindustan company from M/s Durga Automobile. The complainant, accordingly, purchased the vehicle after paying Rs. 5,40,000/- but only after 1 1⁄2 months the vehicle developed mechanical snag. The complainant informed the accused persons but they did not rectify the mechanical snag. The learned counsel for the petitioner submits that petitioner is simply an introducer, who asked the complainant to purchase vehicle from M/s Durga Automobiles. The petitioner did not receive any money but the learned counsel for the complainant submits that petitioner also connived with the owner of Durga Automobiles in cheating the petitioner.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner above named in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Raj Narayan Nigam, learned Judicial Magistrate-XV, Patna in connection with Complaint case No.2260 (C)/2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
