JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 23-03-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with S.T. No. 32/2021 (Jamalpur P.S. Case No. 38/2020), registered for the punishable under Sections 341, 323, 302, 307, 324, 504, 506/34 of the Indian Penal Code.
The specific allegation against the petitioner and coaccused Bittu Kumar Das is that they inflicted repeated knife blows on the person of the deceased.
The learned counsel for the petitioner has submitted that the petitioners is innocent and has falsely been implicated in this case. He is a person of clean antecedent and is under custody since 03.03.2020.

Thakur, the learned APP has opposed the prayer for bail and submitted that the FIR itself shows that the wife of the deceased is an eye-witness and before her eyes, her husband was stabbed to death at the hands of the petitioner. The dying declaration of the deceased has been mentioned in paragraph no. 50 of the case diary, in which he has corroborated the recitals of the FIR and has stated categorically that it was the petitioner, who inflicted repeated knife blows on his person, whereas co-accused Bittu Kumar Das had caught hold of the deceased. He has submitted further that sharp cut injuries was found on the person of the deceased, which shows that he suffered knife blow injuries.
In my view, the petitioner does not deserve the privileges of bail, which is hereby rejected. (Nawneet Kumar Pandey, J) Nirmal/Kundan U T
