The petitioner who is a Ward Member of Ward No. 14 of Shadipur Bhutaha Panchayat of Baisi Block in the District of Purnea, apprehends his arrest in connection with Baisi P.S. Case No. 163 of 2019 registered for the offence punishable under Sections 420/385/ 384 of the Indian Penal Code. Learned counsel for the petitioner submits that the only allegation against the petitioner is that while flood relief was being distributed, the petitioner included the name of one recipient after taking rupees five hundred. Learned counsel for the petitioner further submits that the petitioner has no role to play in including the name of any recipient rather it is the Panchayat Secretary who draws up the list and he has no say in the matter.

Case No. 163 of 2019, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Anjana Mishra, J) Saif/- U T
