The petitioner seeks regular bail in connection with Sasaram (Muffasil) P.S. Case No. 959 of 2017 instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
The allegation is regarding recovery of 103 litres of illicit country made Jharkhand wine from a house from where the coaccused namely Ram Lal Takur was arrested and he is said to have disclosed to the Police that the petitioner was the person to whom they were selling the said illicit liquor.
The learned counsel for the petitioner submits that no recovery has been effected from the person of the petitioner, and
Patna High Court Cr.Misc. No.63309 of 2017 (2) dt.17-01-2018 2/2 he is languishing in custody since 18.09.2017. It is submitted that four other cases are pending against him on same and similar allegation.
Considering the nature of accusation and the period of custody already undergone by him, I deem it fit and proper to enlarge the petitioner above named on regular bail on furnishing bail bond of Rs. 2,00000/- (rupees two lakh) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Court Excise, Rohtas at Sasaram in connection with Sasaram (Muffasil) P.S.
