Petitioner, already in custody, seeks bail in connection with Mashrak PS Case No.86 of 2015, registered under Sections 341, 323, 379, 504 and 34 of the Indian Penal Code. Allegation in the FIR is that while the informant was returning back, on the way, he was robbed by the accused persons and relieved him of cash, ATM Card, gold chain, ring, wrist watch and mobile but motorcycle was not taken away by the accused.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated by the informant as there is some dispute with his co-villager, Santosh Ram, one of the co-accused, however, no incriminating material has been

Having considered the aforesaid facts and circumstances, petitioner Biresh Bind is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-VI, Saran, Chapra in connection with Mashrak PS Case No.86 of 2015.
