JUSTICE SUDHIR SINGH ORAL ORDER 22-10-2019 Heard learned counsel for the petitioner, learned counsel for the informant and learned counsel for the State. The petitioner seeks bail in a case for the offence registered under Sections 341, 342, 323, 324, 325, 307, 354 and 506/34 of the IPC.

The prosecution story, in brief, is that co-accused Sujain Kumar Singh @ Sonu alongwith two unknown persons came at the place of occurrence and they started outraging modesty of women. On protest being made by the informant, Sujain Kumar Singh @ Sonu alongwith two accomplices started chasing him. In the meantime, Manoj Kumar Singh and Siddheshwar Singh (petitioner) chased him and intercepted him. Manoj Tiwary and Siddeshwar Singh instructed Sujain Kumar Singh @ Sonu. Thereupon, Sujain Kumar Singh fired upon him and thereby injury was caused in his Panjara. On instruction of

Patna High Court CR. MISC. No.63692 of 2019(2) dt.22-10-2019 2/2 this petitioner, unknown persons fired twice and thereby injury was caused in his chest and arm. He fell on the ground. The informant was admitted in the Hospital.

It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 13.08.2019. The petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner is an order giver. No injury is attributed against the petitioner. The petitioner has been made accused in the present case due to previous enmity. On behalf of the State and the informant, it is submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 12, Saran, in connection with Bheldi P.S.
