The present petition has been filed for modifying the order dated 12.12.2019, passed in Cr. Misc. no. 73057 of 2019 to the extent the petitioner has been directed to mark his presence before the officer-in-charge of the concerned Police Station at 10 am on each and every Monday of the month and instead substitute the said condition by granting liberty to the petitioner to mark his presence before the officer-in-charge of the concerned police station once a month.

It is submitted by the learned counsel for the

No.4105 of 2023(2) dt.18-01-2023 2/3 petitioner that right from the day, the petitioner was enlarged on bail, the petitioner has been adhering to the aforesaid condition imposed upon him and has not defaulted till date, however, now it is becoming difficult for him to earn his livelihood, for which he has to travel outside the district, hence, it is prayed that the aforesaid condition be modified to the aforesaid extent.

Having regard to the submissions made by the learned counsel for the petitioner as also considering the averments made in the present petition, I deem it fit and appropriate to modify the aforesaid order dated 12.12.2019 to the extent that now the petitioner shall mark his presence before the officer-in-charge of the concerned Police Station at 10 am, once a month and in the event of his failure to do so on two consecutive occasions, the privilege of bail granted to the petitioner vide order dated 12.12.2019, passed in Cr. Misc. no. 73057 of 2019 shall stand cancelled automatically and the petitioner shall be taken into custody forthwith. It is further directed that the aforesaid modified condition shall be adhered to by the petitioner till the framing of charges by the learned trial court.
