JUSTICE MOHIT KUMAR SHAH ORAL ORDER 04-01-2018 Heard the learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner is apprehending his arrest in connection with Karpi P.S. Case No. 30 of 2014 registered for offences punishable under Sections 341, 323, 384 and 387/34 of the Indian Penal Code.
It has been alleged by the informant that on 26.02.2014 at about 9.30 P.M., three unknown miscreants armed with country made kattas came at his brick kiln and snatched mobile as also assaulted for extorting money and on refusal to pay the money, threatened him with dire consequences. It is also alleged that three unknown miscreants also went to other brick Kiln and committed the said offence.
Learned counsel for the petitioner submits that F.I.R. has been lodged against unknown persons and the name of

No.62617 of 2017 (2) dt.04-01-2018 2/2 the petitioner has surfaced during course of confessional statement made by the co-accused person, however, there is no material against the petitioner to establish the complicity of the alleged occurrence except, confessional statement of co-accused Vijay Yadav. It is further submitted that the petitioner has clean antecedent and similarly situated co-accused person has already been granted anticipatory bail by this Court by order dated 02.11.2017 passed in Cr. Misc. No. 43627 of 2017. Having regard to the facts and circumstances of the case, it is directed that the above named petitioner, in the event of his arrest/surrender within six weeks from today before the Court be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Arwal in connection with Karpi P.S.Case No. 30 of 2014. subject to the conditions enumerated under Section 438 (2) of Code of Criminal Procedure.
