2. The petitioner apprehends her arrest in a case registered for the offence punishable under Sections 420 and 406 of the Indian Penal Code.

3. As per prosecution case, this petitioner is alleged to have taken the benefit of Pradhan Mantri Awas Yojana two times.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is ready to deposit Rs. 45,000/- (Forty Five Thousand Rupees) allotted to her in under Pradhan Mantri Awas Yojana. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail.

6. Considering the aforesaid facts and circumstances, undertaking of learned counsel for the petitioner that petitioner is ready to deposit Rs. 45,000/- (Forty Five Thousand Rupees) and her clean antecedents, the prayer for grant of anticipatory bail to the petitioner is allowed.

7. Accordingly, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate First Class, Gaya, in connection with Guraru P.S. Case No.123 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure with further following conditions: "(A.) Petitioner would deposit the aforesaid amount at the Nazarat of the learned Civil Court, Gaya. (B.) The aforementioned payment will be subject to final outcome of the case.

(C.) If the petitioner fails to comply with the aforesaid direction of this court, the learned court below is free to cancel the bail-bond of the petitioner." (Prabhat Kumar Singh, J) shashank/- U T
