2. The petitioner seeks bail in connection with Amarpur (Fullidumar) P.S. Case No. 341 of 2016 registered for the offence under Sections 147, 148, 149, 341, 302 of the Indian Penal Code and Section 27 of the Arms Act.

3. The accused/petitioner is named in the F.I.R. and is in custody since 20.06.2025.

4. The allegation against the petitioner is to commit murder of father of the informant alongwith other co-accused persons by causing firearm injury due to previous enmity arising out of land disputes.

5. Learned counsel appearing on behalf of the petitioner

Patna High Court CR. MISC. No.66080 of 2025(2) dt.05-12-2025 2/3 submitted that admittedly as per FIR, the informant is not the eyewitness of the occurrence and she being daughter of the informant raised suspicion qua involvement of 13 named co-accused persons for the reason that they found going ahead the dead body of the father of the informant after the occurrence out of whom, some accused persons are equipped with firearm and some are equipped with lathi. It is submitted that petitioner equipped with lathi, where admittedly the death was caused due to gunshot injury. It is also pointed out that named co-accused Anil Panjiyara having allegation to equipped with firearm has already granted bail by one of the learned co-ordinate Bench of this Court through Cr. Misc. No. 44243 of 2025 dated 06.08.2025. While concluding argument, it is submitted that investigation of this case is already completed, for which charge-sheet has been submitted, as such, there is no chance of tampering with the evidence and, moreover, petitioner found involved in two more criminal cases.

6. Learned APP opposed the prayer of bail.

Considering the aforesaid factual submissions and by taking note of fact as petitioner found equipped with lathi, where admittedly as per version of informant, death was caused due to gunshot injury, coupled with the fact that investigation of this case is already completed, where petitioner remains in custody since

Case No. 341 of 2016, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka/concerned Court, subject to the conditions as mentioned under Section 437(3) of the Cr.P.C./Section 480(3) of BNSS.
