The petitioner seeks bail in connection with Mohammadpur P.S. Case no. 9 of 2018 registered under Section 30(a) of Bihar Prohibition & Excise Act-2016. 149 lts. of country made liquor is said to have been recovered from a car and petitioner who happens to be driver of the said car was apprehended.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. He has no concern with the seized liquor. As a matter of fact, there was some altercation with the police party over displaying of the original documents

Patna High Court Cr.Misc. No.14092 of 2018(3) dt.25-04-2018 2/2 of the car during course of checking and due to said altercation, the police has falsely implicated the petitioner in the case. He has no criminal antecedent. He has been languishing in custody since 25.01.2018.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Iind Additional Sessions Judge-cum-Special Judge, Gopalganj in connection with Mohammadpur P.S.
