2. The petitioner apprehends his arrest in connection with Didarganj P.S. Case No. 297 of 2022, registered under Sections 30(a) and 36 of the Bihar Prohibition and Excise Amendment Act, 2022.

As per the first information report, on a secret information that illicit liquor is carried out in a grey colour Hyundai Santro Car bearing Registration No. BR-01-AW-9484, the car was intercepted and the two persons were apprehended. On search, illicit country made liquor to the tune of 500 liters was recovered and the car and the liquor were seized.

4. Learned counsel for the petitioner submits that the name of the petitioner has surfaced on the basis of the fact that

No.66225 of 2025(2) dt.24-09-2025 2/3 the seized vehicle belongs to the petitioner, whereas this petitioner is said to have sold out the vehicle to one Dheeraj Kumar, son of Vishnu Daya Singh of Village Sonama, P.S. Didarganj, Patna, on 15.04.2024 itself. The police has already arrested two persons from the place from where this seizure has been made. The further allegation against the petitioner is that he has fled away from the spot, while two persons were intercepted. The petitioner has one criminal antecedent, in which he is on bail.

5. Without accepting the guilt, learned counsel for the petitioner proposes to deposit Rs.10,000/- in the welfare account of the Advocate Association of the Patna High Court.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, above named, is directed to be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Patna City, in connection with Didarganj Excise P.S. Case No. 297 of 2022 subject to the condition as laid down under Section 482 (2) of the B.N.S.S., 2023 and on production of the receipt showing
